Do I Need a Montgomery County Parental Rights Lawyer?

To file a termination of parental rights case, which will formally end the parent-child relationship between a child and his or her parent, you will either have to sign an “affidavit of voluntary relinquishment” (if you are looking to terminate your own parental rights to the child–such as if you are giving the child up for adoption) or an “affidavit of waiver of interest” which will give up your interest in the child.

That being said, when one parent does not agree to voluntarily relinquish their parental rights, it will initiate an involuntary termination of parental rights case. Generally, this happens when one parent has an alleged substance abuse issue, has exposed their child to domestic violence, or otherwise poses a risk to their child and the child’s other parent is looking to terminate their parental rights. Courts will ultimately decide based on whatever they feel is in the child’s best interests, and if they believe the termination will benefit the child, they will do so.
