What Makes a High Net Worth Divorce Different

The legal framework is the same for every Texas divorce, but the financial stakes change everything about how a high-asset case is handled. More property means more to characterize, value, and divide, and more incentive for disputes over each. Cases at this level commonly involve:

  • Closely held businesses, professional practices, or partnership interests
  • Real estate holdings beyond the marital home, including investment and commercial property
  • Executive compensation such as stock options, restricted stock units, and deferred comp
  • Retirement and investment accounts requiring careful division and tax planning
  • Separate property that has become commingled with community assets over the years
  • Concerns about a spouse hiding, undervaluing, or dissipating assets

Each of these introduces questions that a standard divorce never raises. Getting them right requires counsel who understands both the law and the financial machinery underneath it.

How Texas Property Division Works in High-Asset Cases

Texas is a community property state. Most property either spouse acquires during the marriage is presumed to belong to the community and is subject to division when the marriage ends. Separate property, generally what a spouse owned before marriage, plus gifts and inheritances received individually, stays with that spouse, but only if it can be proven separate.

Texas does not divide community property down the middle. Courts divide it in a manner that is "just and right," which means a judge can award one spouse more than half based on factors such as each spouse's earning capacity, fault in the breakup, and the needs of any children. In a high-asset case, that discretion is significant. The difference between a 50/50 split and a 60/40 split can run into seven figures, which is why each asset is characterized and valued matters so much.

Complex Assets We Help Untangle

The harder a divorce is financially, the more value there is in precise, well-supported work. We regularly handle the assets that make high-net-worth divorce complicated:
