What Is an Uncontested Divorce?

An uncontested divorce is one where both spouses agree on every issue the court must resolve, with no disputes left for a judge to decide. Most are filed as no-fault divorces on the ground of insupportability, meaning the marriage is no longer workable and neither spouse needs to prove wrongdoing.

This route tends to work best for couples who are on reasonable terms, have already discussed how to handle their property and any children, and want to keep the process private and low-conflict.

Texas Requirements for an Uncontested Divorce

Before you can file in Texas, basic residency and procedural requirements must be met:

  • One spouse must have lived in Texas for at least six months and in the filing county for at least 90 days.
  • Both spouses must agree on all terms, including property, debts, and any issues involving children.
  • The agreement must be put in writing and signed in a final decree the court approves.

Meeting these requirements keeps your case on the uncontested track. If one is missing, the filing can stall.

  3. Both spouses sign an Agreed Final Decree of Divorce setting out all the terms.
  4. The mandatory 60-day waiting period runs from the date of filing.
  5. A judge reviews the decree and signs it, finalizing the divorce. Depending on the court and case details, a short prove-up hearing may be required.
