Ruby Bolton and the Bolton law firm really showed up for the case my wife had against her ex-husband. From her first visit at consultation to picking up the final draft, she felt like she was in good hands. At the end of all this, my wife was able to get some relief and was able to put her ex in check. We got the passport docs, got it to make it mandatory to take the kids to all their sporting events on his weekend, and his child support was reinstated.- David V.

How Separation Agreements Work In Texas
Texas does not recognize legal separation in the same formal way that some other states do. Couples are either married or divorced. Even so, spouses can sign written separation agreements that address how they will handle property, debts, support, and parenting while they live apart or work through the divorce process. These agreements can carry significant weight later, which is why careful drafting and review are so important.
A separation agreement can cover practical questions like who remains in the home, how mortgage or rent will be paid, and who will be responsible for specific debts. It can address access to joint accounts, temporary support so that one spouse can meet basic expenses, and how you will handle health insurance and other ongoing obligations. Parents often use these agreements to set schedules for where the children will live, how holidays will be shared, and how decisions about school or health care will be made.
Texas applies a community property system to many assets acquired during the marriage. That means property and debts are often viewed as belonging to both spouses, regardless of whose name is on a title or account. When we help a client with a separation agreement, we look at community and separate property concepts so the terms align with how a court in Texas is likely to view the assets if a divorce is later filed.
Custody in Texas is usually described in terms of conservatorship and possession rather than simple custody and visitation. In Fort Bend County, judges typically focus on the best interests of the child when reviewing parenting arrangements. If you later file for divorce or a suit affecting the parent child relationship, the court may review your prior written agreement and decide how much to incorporate into temporary or final orders. It is not automatic, but judges often give serious consideration to fair, well drafted agreements, especially when they have worked smoothly for the children.
Before you sign any separation agreement, it helps to take these steps:
- Gather information about your income, household expenses, debts, and major assets.
- Write down your goals and non negotiables for parenting time, housing, and finances.
- Consider how any proposal might affect you if it later appears in front of a judge.
- Speak with a separation agreement lawyer Sugar Land to review the terms before you agree in writing.

-
What Happens to Debt in a Texas Divorce?Debts incurred during the marriage are generally treated as community debts, just as assets are community property. The court will divide responsibility for debts as part of the property division. Note that a divorce decree does not automatically relieve you of liability to creditors — if your spouse is ordered to pay a joint debt and fails to do so, creditors may still pursue you. We help clients address this risk through careful drafting of divorce agreements.
-
Can Our Custody Arrangement Be Changed After the Divorce Is Final?Yes. Texas courts can modify custody, visitation, and child support orders when there has been a material and substantial change in circumstances since the original order was entered. Common triggers include a parent's relocation, a change in the child's needs, or a significant change in either parent's financial situation.
-
What if My Spouse Hides Assets During the Divorce?Texas requires both parties to disclose their financial information. If you suspect your spouse is concealing assets, we can pursue formal discovery — including depositions, subpoenas, and forensic accounting — to identify and value hidden property. Courts take asset concealment seriously, and it can affect the fairness of the final division.
