Legal Definition of Injunction

An injunction is a court order that requires a party to either stop engaging in certain conduct (referred to as a “negative injunction” or “prohibitory injunction”) or to take specific actions (referred to as a “mandatory injunction”). 

In family law cases, these are commonly used to address issues such as domestic violence, harassment, property disputes, child custody matters, and the preservation of assets during divorce proceedings.

How Injunctions Work in Texas Family Law Cases

In Texas family law cases, injunctions may be issued by the court upon the request of one party (the petitioner) to prevent the other party (the respondent) from engaging in harmful or disruptive behaviors that could adversely affect the outcome of the case.

Here’s how these orders work in Texas family law cases.

Filing of Petition

The petitioner files a petition with the appropriate court requesting the issuance of an injunction to address specific issues or concerns arising from the family law matter. The petition must outline the reasons for seeking this order and provide supporting evidence and documentation to justify the request.

Notice and Hearing

Upon receiving the petition, the court may schedule a hearing to consider the merits of the request. Notice of the hearing and a copy of the petition must be provided to the respondent to ensure due process and an opportunity to be heard.

In urgent situations where immediate action is needed, the court may issue a temporary restraining order (TRO) ex parte, without notice to the respondent. A TRO is a temporary restriction that remains in effect for a limited period, typically until a hearing can be held to determine whether to grant a permanent order.

Evidence and Testimony

At the injunction hearing, both parties have the opportunity to present evidence, testimony, and legal arguments regarding the necessity of the order and the potential harm or irreparable injury if the order is not granted. The court evaluates the evidence and considers the best interests of the parties and any children involved in the case.

Scope and Duration

The scope and duration of an injunction in a Texas family law case may vary depending on the specific circumstances of the case and the relief sought by the petitioner. They may be temporary or permanent and may address issues such as domestic violence, harassment, property disposition, financial transactions, child custody, visitation, and communication between the parties.

Enforcement and Violation
